At left is attorney James MacInnis. A jury last night refused to indict Mrs. O'Malley for the fatal shooting of her husband, and she was freed today. In a state of near collapse, she'll be taken to a hospital for rest. [second newscopy:] Mrs. Carolyn O'Malley, the slight, 34-year-old housewife who shot and killed her husband New Year's Eve, was free today, under care of the parents of the man she killed. Last night the County Grand Jury refused to indict her for slaying John O'Malley, a state highway patrolman. She spent the night in San Francisco Hospital instead of in jail, and today the district attorney's office dropped the case, leaving her free to return to her Sunset District home and her four daughters. Witnesses Defend Her--But her mother- and father-in-law, Mr. and Mrs. John O'Malley Sr., indicated they will put her in a hospital for a complete rest, after taking her to see her children, because she is near collapse. The grand jurors did not come to their decision until they had heard many witnesses testify in behalf of Mrs. O'Malley. Among these witnesses were her two oldest daughters, Carolyn, 11 and Jacklyn, 10, and her father-in-law. Backed Her Story--All the witnesses substantiated Mrs. O'Malley's story--the one she told the night of the slaying and tearfully repeated last night. It was the story of a man who was a good husband and father until he bacame subject to increasing frequent rages, times when he beat his wife and threatened her with death. The witnesses also agreed that Mrs. O'Malley was protecting her life when she killed her husband with his own .38 revolver."
